Welcome to Kristen Trimm Gallery ("Company", "we", "our", or "us"). 1. Eligibility

2. Custom Painting and Commission Services

Kristen Trimm Gallery offers original and custom-painted artwork. All projects are handled with personalized consultation and care. The following terms apply:

  • Design Approval: Clients must approve final concepts or mock-ups before the painting process begins.
  • Payment Terms: A non-refundable deposit (typically 50%) is required before the start of any commissioned work. Remaining balance is due upon completion and before delivery or shipping.
  • Production Time: Estimated completion times are provided during consultation but may vary due to workload, drying time, and availability of materials.
  • Revisions: Minor revisions may be included in the cost. Major revisions or changes after approval may incur additional charges.

3. Pricing and Payments

All prices are listed in U.S. dollars (USD). We reserve the right to modify pricing at any time without prior notice. Accepted forms of payment include credit/debit cards, PayPal, Venmo, and bank transfers. Full payment must be received before any artwork is released or shipped.

4. Shipping, Delivery & Pickup

  • Local Pickup is available from our studio at:
    408 Olive Street, Kansas City, MO 64124
  • Local Delivery may be arranged within the Kansas City area upon request.
  • Shipping is available for domestic U.S. orders. Rates are calculated at checkout.
  • Once the artwork is delivered or shipped, risk of loss or damage passes to the buyer.

5. Cancellations & Refunds

  • Commissioned Artwork: Due to the custom nature of commissioned artwork, all sales are final once the project has begun.
  • Cancellation Window: Cancellations must be made within 24 hours of placing a custom order to be eligible for a refund of the deposit.
  • Non-Custom Products (if offered): May be eligible for return or exchange within 15 days if unused and undamaged. Shipping costs are non-refundable.

6. Intellectual Property

All artwork, images, text, and content on this Site are the property of Kristen Trimm Gallery and are protected under U.S. copyright and trademark law.

  • Client Use: Commissioned pieces are for personal display and may not be reproduced, sold, or used commercially without a written license agreement.
  • Gallery Use: We reserve the right to display images of completed commissioned work in our portfolio, exhibitions, or promotional materials unless otherwise agreed.

7. Prohibited Conduct

You agree not to:

  • Violate any laws or regulations in connection with your use of the Site or Services;
  • Infringe on our intellectual property or that of others;
  • Submit false information or impersonate another person;
  • Interfere with the functionality or security of the Site.

8. Disclaimer of Warranties

All services and products are provided “as is” and “as available.” We make no warranties, express or implied, regarding the quality, reliability, or availability of our artwork or Site.

9. Limitation of Liability

These Terms are governed by and construed in accordance with the laws of the State of Missouri. Any legal disputes shall be resolved in the state or federal courts located in Kansas City, Missouri.
